STATUTORY MANDATE, NON-GOVERNMENTAL AUTONOMOUS CHARTER & COMPLIANCE UNDERTAKING

CLAUSE 1: AUTONOMOUS INSTITUTIONAL DEFINITION & DISCLAIMER OF GOVERNMENT AGENCY: The applicant training provider hereby explicitly acknowledges, comprehends, and agrees that the NSQF Council operates strictly as an autonomous, self-regulated private evaluation body, trust-registered certification registry, and independent skill curriculum mapping authority. Under no circumstances shall the applicant center, its management, staff, or representatives represent, market, advertise, or imply to candidates or the general public that the Council is a direct Central or State Government Ministry, Department, Statutory Educational Board, or University.

CLAUSE 2: PROHIBITION OF GOVERNMENT EMBLEMS, SYMBOLS & FALSE IMPERSONATION: The affiliated center is strictly prohibited from utilizing the official Ashoka Emblem of India, the National Flag graphic, official government department watermarks, or direct regulatory agency logos (including Skill India, NCVET, or MSDE official insignias) on their localized banners, leaflets, fee receipts, or unauthorized certificates. All public marketing material issued by the center must explicitly incorporate the disclaimer: "Affiliated with NSQF Council — An Independent Autonomous Skill Assessment Body."

CLAUSE 3: CURRICULAR ALIGNMENT & EMPLOYABILITY ORIENTATION: The certifications, grade sheets, and credit mappings issued under this affiliation are structured autonomously based on outcome-driven performance criteria aligned with National Occupational Standards (NOS). The applicant center agrees that these certifications serve as technical competency credentials to enhance candidate employable mobility and do not confer automatic state degree equivalence unless explicitly recognized by specific individual hiring entities.

CLAUSE 4: NON-REFUNDABILITY OF ONBOARDING TARIFFS & FINANCIAL INDEMNITY: All affiliation fees, center inspection charges, syllabus mapping tariffs, and candidate registration dues submitted to the Council database are strictly non-refundable, non-transferable, and non-negotiable under any administrative or legal circumstances. The parent Council bears zero liability for local center operational overheads, building leases, employee salaries, or localized fee disputes between the center and its students.

CLAUSE 5: ZERO-TOLERANCE COMPLIANCE AUDIT & JURISDICTION: Any verified breach of these non-misrepresentation mandates, false promises of government employment, or unauthorized printing of restricted symbols shall result in immediate termination of affiliation without prior notice or financial refund, accompanied by potential statutory legal proceedings. All legal disputes shall be subject strictly to the exclusive judicial jurisdiction of the Council's registered trust headquarters.

Statutory Terms of Affiliation & Legal Charter

Comprehensive Legal Manifesto & Autonomous Operating Boundaries

1. NON-GOVERNMENTAL AUTONOMOUS DECLARATION: The NSQF Council operates autonomously as an independent, self-governing evaluation authority and skill assessment registry registered under trust/society norms. The Council is NOT a direct Central Government Ministry, State Board, or University. Affiliated centers must explicitly communicate this status during candidate counseling.

2. RESTRICTION ON GOVERNMENT EMBLEMS & LOGOS: The center shall not print or display the Ashoka Emblem, National Flag, "Skill India", "NCVET", or "MSDE" logos on their localized advertising materials, fee receipts, or training certificates. Violations will result in immediate cancellation of affiliation and potential statutory prosecution.

3. OUTCOME-BASED QUALIFICATION STANDARDS: All courses mapped by the Council are based on practical competency evaluation parameters aligned with National Occupational Standards (NOS). Certifications validate practical skill proficiency to boost employable value.

4. FINANCIAL NON-REFUNDABILITY: All affiliation onboarding fees, center inspection tariffs, course alignment fees, and student exam registration charges paid to the Council are strictly non-refundable and non-transferable.

5. INDEMNIFICATION: The center agrees to indemnify and hold harmless the Council, its trustees, directors, and evaluation officers from any legal claims, student disputes, or financial liabilities arising from local center operations.

6. JURISDICTION: All transactions and agreements are governed strictly by the laws of India, subject exclusively to the judicial jurisdiction of the Council's registered trust headquarters.
